Support the ACLU: Protect the Right to Vote

From litigation to responding to threats at the state level to direct voter education, the ACLUF and ACLU are dedicated to ensuring that the 2026 elections are fair, representative, and reflect the best of democracy.

The Supreme Court’s devastating recent ruling in Louisiana v. Callais – which stripped critical federal protections against discriminatory voting systems and struck down a map with two majority-Black districts in Louisiana – is part of a larger pattern to undermine the rights of Black voters. We are now seeing states like Georgia, South Carolina, and Tennessee immediately call for special sessions to redraw maps for partisan gain and dilute Black voters' power, some in the middle of ongoing elections. The decision opens the door for lawmakers to enact discriminatory maps and roll back voting rights with impunity, threatening Black voters’ equal opportunity to shape our policies and politics. Its reach extends beyond congressional redistricting to challenges involving state legislative and local election systems across the country.

In the immediate term, we will continue defending communities currently in redistricting litigation, where the Callais ruling has direct consequences for voters seeking relief from vote dilution, restrictive registration requirements, and discriminatory changes to election administration. We must condemn this abuse of power and work for a democracy where every eligible voter can participate freely.

Here are a few updates on our voting rights work as we approach the 2026 elections:

- In a victory for voting rights, the state of Montana ruled to keep Election Day voter registration. Senate Bill 490 – which was passed during the 2025 Montana legislative session – is enjoined and may not go into effect. Eliminating Election Day registration would disproportionately burden Native communities, who often rely on being able to both register and cast a ballot on Election Day. - The ACLU and ACLU of TN are suing to block a redrawn and discriminatory congressional map in Tennessee that silences Black Memphians. Mid-decade congressional redistricting has been illegal under state law for over 50 years and yet, a white-controlled supermajority of the Tennessee General Assembly enacted the new map. This map dismantles a near century old Memphis-based congressional district and the state's only majority-Black district. - The ACLU and other voting rights groups requested a restraining order to keep an Alabama congressional map, after the Supreme Court reinstated a discriminatory map from 2023. The current court-ordered map was put in place after court findings revealed that Alabama intentionally discriminated against Black voters when it drew the 2023 map. With voting already underway for the state's May 29 primary election, this is yet another decision by the Supreme Court to undermine the rights of Black voters.
